Terms of Service

ARTICLE 1 – Purpose

These Terms of Service define the conditions of access and use of the EquoTrack SaaS service by users.

ARTICLE 2 – Service Access

Access to the service requires creating an account with a username and password. The user undertakes to provide accurate information.

ARTICLE 3 – Liability

The publisher implements the necessary means to ensure service availability but does not guarantee the absence of interruptions.

ARTICLE 4 – User Behavior

The user undertakes not to use the service for illegal purposes and not to harm its operation.

ARTICLE 5 – Intellectual Property

The service content is protected by copyright. Any unauthorized reproduction is prohibited.

ARTICLE 6 – Termination

In case of non-compliance with the Terms of Service, the publisher reserves the right to suspend or delete access to the service.

ARTICLE 7 – Applicable Law

These Terms of Service are governed by French law.

And: the Customer, a consumer subscribing to the EquoTrack Service.

Together referred to as the "Parties" and individually as a "Party".

EquoTrack provides an online SaaS platform dedicated to monitoring, analysing, and optimising business activity.

ARTICLE 1 – General provisions

  • 1.1 These Terms of Sale govern the subscription and use of the Service by the Customer.
  • 1.2 The Service refers to the features offered by EquoTrack on the Website, accessible once the Subscription is activated.
  • 1.3 The Customer acknowledges being a consumer and having reviewed the characteristics of the Service before ordering.
  • 1.4 These Terms prevail over any other document and remain valid even if a clause is deemed invalid.

ARTICLE 2 – Pre-contractual information

Pursuant to Articles L111-1 et seq. of the French Consumer Code, the Customer acknowledges having received, prior to confirming the order:

  • • Key characteristics of the Service;
  • • Price and payment terms;
  • • Termination and refund conditions;
  • • Technical requirements (internet connection, recent browser, compatible device).

ARTICLE 3 – Purpose

These Terms define the conditions under which EquoTrack grants the Customer a personal, non-exclusive, non-transferable right to use the Service. EquoTrack may improve the Service, subject to prior reasonable notice, allowing the Customer to terminate without charge in case of substantial changes.

ARTICLE 4 – Subscription and access

  • 4.1 The Customer accesses the Service with personal credentials.
  • 4.2 The Subscription is strictly personal and may not be shared.
  • 4.3 Waiver of withdrawal right: pursuant to Article L221-28 of the French Consumer Code, the Customer is informed that:
  • • The Service is available immediately after activation;
  • • By validating the order, the Customer requests immediate performance and waives the statutory withdrawal right.

ARTICLE 5 – Term, renewal, termination

Subscriptions renew automatically for successive periods. The Customer may cancel through the account area at any time; cancellation takes effect at the end of the current period. EquoTrack may terminate for breach after prior notice.

ARTICLE 6 – Pricing and payment

Prices are indicated on the Website in the Customer's selected currency. Payment is processed securely via Stripe on a recurring basis throughout the subscription term.

ARTICLE 7 – Intellectual property

EquoTrack retains all intellectual property rights to the Service. The Customer acquires only a right of use for personal purposes. Any reproduction, distribution or modification is prohibited without prior written consent.

ARTICLE 8 – Personal data

The processing of personal data is described in our Privacy Policy. The Customer may exercise data protection rights by contacting contact@equotrack.com.

ARTICLE 9 – Liability

EquoTrack makes commercially reasonable efforts to ensure access to the Service. The Company cannot be held liable for force majeure events, third-party failures, or damages resulting from misuse of the Service.

ARTICLE 10 – Applicable law and disputes

  • 10.1 Applicable law: French law.
  • 10.2 Jurisdiction: French courts have jurisdiction. The Parties may seek amicable resolution before any legal action.

Acceptance

By validating the order, the Customer acknowledges having read and accepted these Terms of Sale.
